Guidelines of Conduct for MPF Intermediaries 強積金中介人應遵守的操守指引

The Conduct Guidelines connect statutory performance requirements with the minimum conduct standards expected in MPF sales, marketing and advice. Acts or omissions need not appear in the Guidelines to constitute a breach of those requirements.

Guidelines on Conduct Requirements for Registered Intermediaries (Conduct Guidelines) 《註冊中介人操守要求指引》(《操守指引》)

The MPFA issues the Conduct Guidelines under the Mandatory Provident Fund Schemes Ordinance (MPFSO). Their focus is the minimum conduct expected when regulated persons sell or market registered schemes or give advice about them. [MPFA Conduct Guidelines](https://www.mpfa.org.hk/en/-/media/files/information-centre/legislation-and-regulations/guidelines/current-version/part-vi/vi-2/vi_2.pdf)

Statutory performance requirements are duties that regulated persons must fulfil; the Conduct Guidelines help them understand how to comply in practice. The Guidelines also explain circumstances that would satisfy the MPFA that a regulated person has complied, or has failed to comply, with those requirements.

A minimum standard is not a complete catalogue of every situation. An act or omission may breach a performance requirement even though the Guidelines do not mention it. Equally, an unmentioned act is not automatically a breach: the applicable statutory requirement and the circumstances still need to be considered.

Intermediaries must understand the MPFA’s guidelines and other applicable conduct codes under their respective supervisory regimes. Knowing just one set of documents is insufficient. Anyone preparing to conduct MPF intermediary business should study the full Conduct Guidelines, available on the MPFA website under Information Centre, then Legislation & Regulations, then Guidelines.
